Kivrikoglu Urges ‘Group Decision’ On Civil Servants’ Decree
The name of the model is: "Democracy under the guardianship of the army.
We have been living under this regime since Feb. 28, 1997, but no official figure had announced it as openly as he did that day.
Kivrikoglu has declared that the so-called "civil servants decree," which would allow civil servants to be fired without court intervention simply because of their political leaning towards either extreme religious practices or separatism, has been backed by the arm, so strongly that if it does not become law this autumn, the arm, will take it on as a case of prestige.
The army made its attitude about the famous decree clear in the last two meetings of the National Security Council (MGK), but when the general made it "a case of prestige," he seemed to be ignoring the constitutional role of the MGK as an advisory committee.
Kivrikoglu also gave indications as to how Parliament should handle the case. According to him, political parties must make a binding decision in favor of the law contains a very undemocratic clause which urges minority votes from one part, to respect and vote in line with the majority votes in Parliament.
This pre-voting procedure is taken in an innerparty session and it is called "the group decision."
The chief of General Staff is sure that the law will not pass through Parliament if members vote independently.
He also mentioned the "good uses" of the group decision and what we lose when it is not used. According to him, we gained the "obligatory eightyear basic education" by using it and lost Suleyman Demirel as president in the co-called "5+5 voting" because the Constitution prohibits group decisions from changing its clauses.
He also said that the court decision taken at Istanbul State Security Court (DGM) against religious leader Fethullah Gülen's arrest shows how religious reactionaries have infiltrated the legal system.
He added that this would not happen if the decision had been made at the Ankara DGM.
Kivrikoglu implied that he did not care about the spirit of the Constitution which mandates the separation of administrative, judicatory and legislative powers.
In fact, the prosecutor general opened a case in Ankara DGM against Gülen with the indictment that he established a "gang" to overthrow the secular republic.
Gülen's congregation has around 6 million followers.
His gang of bandits must be the largest gang of bandits in the world!
One of the journalists invited to the reception (I was not invited) reported that various soldiers at the reception told him that they were not happy either with the government or the president. Therefore, the general is not alone in his views.
Kivrikoglu also said that parliamentarians should learn how to adjust to the norms of the European Union.
I think that was the joke of Victory Day.
The arm, as positioned by Kivrikoglu, is for the status quo which defends a crony capitalist system and democracy under its guardianship.
If there is a need for change it should be someone else who instigates it.
